1. INTRODUCTION

These Terms and Conditions ("Terms") govern your use of customautogates.com.au ("Website") operated by Custom Auto Gates and Fencing (ABN: 93613351607, ACN: 613351607, QBCC License No: 15022241) ("we," "us," or "our").

2. ACCEPTANCE OF TERMS

By accessing and using our Website, you accept and agree to be bound by these Terms. If you disagree with any part of these terms, please do not use our Website.

3. PRODUCTS AND SERVICES

3.1. Product Description
We offer various products including aluminum gates, steel gates, Colorbond gates, timber fencing, gate automation systems, electric gate motors, solar gate systems, and low-voltage systems. While we endeavor to display accurate product images and descriptions, actual products may vary slightly from images shown.

3.2. Pricing and Payment
All prices are in Australian Dollars (AUD) and include GST where applicable. Prices are subject to change without notice. Payment must be made in full before the commencement of manufacturing. We accept major credit cards and direct bank transfers.

4. ORDERING AND QUOTES

4.1. Online Quotes
Quotes provided through our website are estimates only. Final pricing may vary based on site inspection and specific requirements. Quotes are valid for 30 days from the date of issue.

4.2. Order Confirmation
Orders are only confirmed upon receipt of deposit payment. Custom orders cannot be canceled once manufacturing has commenced. Customers will need to provide measurements of the gate opening or gate sizes required along with colour and design confirmations after payment and prior to fabrication. Changes to colour, design, style or dimensions may result in additional charges.

Drawings are done by Gate Pro at a free cost if purchase is completed or if refund requested then a $150 fee will be deducted from any refund or charged out as separate cost to the buyer.

5. WARRANTY

5.1. Structural Warranty
We provide a 10-year structural warranty on aluminum gates and fences. Warranty covers manufacturing defects and structural integrity. Warranty does not cover: Damage from misuse or negligence, Normal wear and tear, Unauthorized modifications, Improper installation by third parties.

5.2. Automation Systems
Automation systems carry manufacturer's warranty. Terms vary by component and manufacturer. Automation warranties are back to base - meaning you will need to arrange for automation products to be delivered back to our warehouse 45 Belar Street yamanto QLD 4305 at your cost we will ship from us to the manufacturer at our cost. If found to be not warranty then the return shipping costs will be at the buyer's expense.

6. DELIVERY AND INSTALLATION

6.1. Service Areas
CUSTOM MADE GATES & PATIO POSTS are delivered on our own truck to your kerbside / nature strip our crew does not go beyond the fence line. We have a flat rate of $185 for a set area that includes most suburbs of Brisbane, Logan, and Ipswich regions. Additional charges may apply for locations outside these areas.

Automation is delivered via courier and service area is Australia wide based on metro areas.

Customers are welcome to pick up goods from our site packing and blankets are not provided.

7. INTELLECTUAL PROPERTY

All content on this Website, including designs, logos, and images, is the property of Custom Auto Gates and Fencing and is protected by Australian copyright laws.

8. PRIVACY AND DATA PROTECTION

We collect and process personal information in accordance with our Privacy Policy and Australian Privacy Principles.

9. LIABILITY LIMITATIONS

9.1. To the maximum extent permitted by law, we shall not be liable for: Indirect or consequential losses, Loss of profit or business opportunity, Damages arising from third-party services, Force majeure events.

9.2. Our total liability shall not exceed the purchase price of the products.

10. BUSINESS OPERATIONS

10.1. Operating Hours
Monday to Friday, 7.30 AM to 4 PM. After-hours services by appointment only. Public holidays excluded.

11. DISPUTE RESOLUTION

11.1. Any disputes shall be resolved: Initially through direct negotiation, Through mediation if necessary, In accordance with Queensland law, In Queensland courts.

12. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Website.

13. GOVERNING LAW

These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.

14. SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
